The Board’s rule governing Examination and Issuance of Licensure; Lapse of Application (R4-22-104) is not current, in that is refers to examinations that have been replaced by succeeding versions. The Board currently requires an applicant to have passed the successor examinations, specifically all parts of the National Board of Osteopathic Medical Examiners, the Comprehensive Osteopathic Medical Licensing Examinations (COMLEX) or the United States Medical Licensing Examination (USMLE) rather than the National Board of Osteopathic Examiners (NBOE) examination, or the federal licensing examination (FLEX). This information is given to every applicant and is on the Initial Licensure Checklist at www.azdo.gov/ForDOs/NewLicApp.aspx
 
The Board’s rule governing Rehearing or Review of Decision (R4-22-106) is not current, in that it contains language stating that the Board may, for good cause, extend the period of time for filing a request or motion for rehearing. This is not consistent with the AZ Court of Appeals ruling in Stapert v. Arizona Bd. of Psychologist Examiners, 210 Ariz. 177, 108 P.3d 956, 957 (App. 2005). This information is given to parties who have the right to appeal the Board’s decisions.
 
The Board intends to update these rules as soon as possible.
